These Terms govern your use of omeru.io and the WhatsApp commerce bots supplied by REMOLUHLE (PTY) Ltd., trading as Omeru (“we”, “us”, “our”). Please read them before placing an order — by paying for a bot you agree to them.
Who you are contracting with
Your contract is with the company below, not with any individual. These are the disclosures required of a supplier under section 43(1) of the Electronic Communications and Transactions Act 25 of 2002 (ECTA).
Acceptance of these terms
You accept these Terms when you place an order, make a payment, or otherwise use our services. If you are agreeing on behalf of a business, you confirm you are authorised to bind that business. If you do not agree with these Terms, do not place an order — browsing and demoing templates remains free and requires no agreement.
What we provide
We build WhatsApp commerce bots — conversational flows that greet customers, present a catalogue, take orders, answer questions and route payments inside WhatsApp. Our service has three parts:
- Live demos. Every published template has a free, interactive demo. No payment and no account are needed to view one.
- Custom builds. You pay, send us a brief on your business, approve a suggested bot experience, and we build a version customised to you.
- Handover. We walk you through the finished bot on a call and hand it over.
A demo shows what a template does. It is an illustration, not a specification: the bot we build for you is shaped by your brief and the experience you approve.
Pricing and payment
What you pay
We do not publish a fixed price. You decide what the bot is worth to your business and pay that amount. Once paid, that amount is the agreed price for the build described in your approved brief.
How you pay
- Instant EFT (Ozow). When you place an order on this site we hand you to Ozow’s hosted checkout to pay from your South African bank account. A payment link we send you separately, at pay.omeru.io, redirects to the same gateway. Ozow is the payment processor and the payment itself is handled in South Africa; we never see or store your banking credentials.
- Cryptocurrency (Bitcoin or Ethereum). You send the amount to the address shown at checkout and paste the transaction hash into the order form. We verify it against the public ledger before work begins.
All amounts are quoted in South African Rand (ZAR). For crypto payments, the amount received on-chain is what counts; we do not compensate for exchange-rate movement between you sending and us confirming. Where VAT applies it is included in the amount shown.
Work begins only once payment is confirmed — bank confirmation for Ozow, or on-chain confirmation for crypto.
Your brief and approval
After payment you send us a brief describing your business and what the bot should do. From that brief we send back a suggested bot experience — the flow, the tone, and what it will do. You may request changes. When you approve it, that approved experience is the scope of the build.
You are responsible for the accuracy of what you give us: business details, prices, product information, contact numbers and trading hours. We build what the brief describes. Changes requested after approval may be treated as new work and quoted separately.
If you do not send a brief, or do not respond to a suggested experience, we will follow up. An order left without a response for 60 days may be closed; see the Refund & Cancellation Policy for what happens to the payment.
Delivery and handover
Delivery timelines depend on the brief and are communicated to you after we have read it. We do not guarantee a fixed turnaround unless we have given you one in writing. On completion we arrange a call to demonstrate the bot and hand it over.
A bot runs on the WhatsApp Business Platform, which is operated by Meta. Going live requires a WhatsApp Business account and Meta’s approval of your business. We will guide you through this, but we cannot guarantee that Meta will approve any particular business, and their decision is outside our control.
Intellectual property
You own your content — your brand, logo, product information, copy and customer data. You grant us the licence needed to use it for building and operating your bot.
We own what sits underneath the work: the bot templates, the flow engine, and the code and tooling we use to build and run them. On full payment you receive a licence to use the bot we build for your business. You may not resell, sublicense or redistribute the underlying templates or platform.
We may reference that we built your bot, and show a non-confidential demo of it as a portfolio piece, unless you ask us in writing not to.
Acceptable use
You may not use our services, or a bot we build, to:
- Break any law of South Africa or of the country your customers are in.
- Sell goods or services you are not lawfully entitled to sell.
- Send unsolicited bulk messages, or message people who have opted out — WhatsApp’s own policies apply in addition to these Terms.
- Impersonate another business, or misrepresent who is behind the bot.
- Collect personal information unlawfully, or in breach of POPIA.
- Attempt to reverse-engineer, resell or copy the platform.
Breaching WhatsApp’s or Meta’s policies can result in your number being restricted or banned by Meta. That consequence sits with Meta, not with us.
Third-party services
Our services depend on third parties, each with their own terms: Meta (WhatsApp Business Platform), Ozow (instant EFT), and the Bitcoin and Ethereum networks for crypto payments. We are not responsible for their availability, their fees, or decisions they make about your account. Blockchain transactions in particular are irreversible once confirmed and cannot be recalled by us.
Availability and support
We aim to keep omeru.io and delivered bots available, but we do not promise uninterrupted service. Maintenance, third-party outages and network failures happen. Unless we have agreed a separate support arrangement in writing, support after handover is provided on a best-effort basis, and substantial new work is quoted separately.
Liability
Nothing in these Terms limits any right you have under the Consumer Protection Act 68 of 2008 or any other law that cannot lawfully be excluded.
Subject to that, our total liability arising from your order is limited to the amount you paid us for it. We are not liable for indirect or consequential loss — including lost profits, lost sales, lost data or business interruption — arising from the use of, or inability to use, a bot.
You remain responsible for your own regulatory obligations: what you sell, what you say to your customers, and how you handle their personal information.
Suspension and termination
We may suspend or end services where payment is reversed or fraudulent, where the acceptable use rules above are breached, or where continuing would place us in breach of law or of a third party’s terms. Where it is reasonable to do so, we will tell you first and give you a chance to put it right.
You may cancel at any time. What that means for money already paid is set out in the Refund & Cancellation Policy.
Governing law and disputes
These Terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction.
Talk to us first — most disputes are resolved by email within a few days. Write to hello@omeru.io setting out the problem and what you would like done, and we will respond within 10 business days. If we cannot resolve it, you retain every right you have under South African law, including referral to the National Consumer Commission.
Changes to these terms
We may update these Terms. The “Last updated” date at the top always reflects the current version. Changes are not retrospective: the version in force when you paid governs that order.
